Things just got worse for Microsoft, with respect to its newly released Xbox 360 console...

One angry Chicago consumer - Robert Byers, has filed a class-action lawsuit in an Illinois federal court, alleging that Microsoft is peddling a "defectively designed" product.

The lawsuit claims, that in Microsoft's bid to gain share in the approximately $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing Gen-Next machines from Sony and Nintendo, that it actually sold a "defectively designed" product.

Byers who purchased the Xbox 360, said the console has a flaw which causes the hardware to overheat and freeze in the middle of game play.

Interestingly some other gamers who bought the 360 have also complained about similar problems on Internet sites, since the console went on sale November 22 in USA.

Although Microsoft has refrained from commenting on the lawsuit, Tara Mulcahy, a Microsoft spokes-person, reportedly said, that there was no systemic issue with Xbox 360.

With the heated on-going battle over Gen-Next video game consoles, Xbox fans can only hope that this development does not succeed in tipping the scales against Microsoft and its pet console.

i heard that only 5% have bugs on them my friend got one and has had NO problems with it

i never get new systems the first year they come out after what happened to me with the first xbox. Wouldnt read disks after a while.

Sounds kinda like paintball guns, let someone else buy em and have the problem, wait a bit and then get em cheaper anyway after the bugs are worked out.

Ya my brother bought one has hasnt had one problem with it. He usually leaves the thing on all the time too!

ign did a article on this. a lot of people have been having problems and you have to send the console to texas to get it fixed. 5 day turnaround time usually. the lawsuit is a joke and isnt gonna fly, you cant sue someone over a defective product cause no one is perfect, even though microsoft likes to think they are. alot of people have also been having problems with the console eating up disks, scratching the hell out of them, and then the places they bought the games from wont give them their money back. yeah, once again microsoft sucks. ps3 is gonna be tons better.

sounds more like some Jackass that thinks because Microsoft has a lot of money, he should to. So he sues them because his game system froze on him. I hate hearing that kind of crap. Everyone is so sue happy now, its a joke.

my computer freezes up on games sometimes....i dont go and sue microsoft for it though....whats the difference?

Gosh going on this same thing I should have sued Valve and/or Steam when they came out with Half Life 2. Luckily I only had it freeze up once and that was 10 mins away from the end.

But I know people were freezing up and locking up their machines through out the whole game. The biggest was that it was using all the memory.

Go figure. I think a judge just needs to make some standards and tell people tuff. Every one is so sue happy.

I got it next time one of you guys shoot me on the paintball field I am going to take you to court cause you caused me pain and suffering. Because you shot me it hurt and it left a bruise that gave me a complex that I don't look good.

Think about it I could go on forever.

Anything that uses new technology is going to have some bugs. Especially windows! Does anyone remember Windows 3x or Windows 95? Those operating systems changed the way we looked and used computers, but they had more problems then anything I can remember. It seemed like each week you would download a patch to fix what the last patch broke. The same thing applies to video game consols. Xbox has come out with a great new console that, when it works, is amazing. It will take some time for them to fix all the bugs but when it is fixed it will be great.
