I had talked to nich of ballistic earlier today, and wanted me to say that he was sorry for the way he acted, and congratulations to the team, because playing a man down, and taking the tournament is a big feat. But he was just protecting his dad, because i guess when his dad was hit, and walking away, tommy tucker told his team to keep on firing at kevin until he got out, so that's where nich got pissed off, and then shot tommy in the back. Then when he was walking off tommy didn't know it was nich who shot him, so he pushed him, so nich turned around, and told tommy good luck in the future games, and then put 2 in his chest becuase of what tommy did to kevin. Because take into fact this... tommy and ryan tucker had been stayin' at kevin's house for the past 3 months and from what i hear, they haven't had to pay anything. Then with tommy's actions that's where it mostly comes from. I'm just speaking upon nich, i wasn't there, i didn't see it. But mostly he's just trying to say sorry for his actions, and that his dad didn't instruct him to take those actions.

Oh, I see, that makes it all ok? I refer back to the previous. They represent their store. They HAVE to adhere to a higher moral code. Instead they lead a charge of a downward spiral into oblivion. I saw the game. Tommy didnt tell his team that. Like I said before. Kevin walked through a lane. It was unfortunate, but it happens.

Nich has always been a decent guy to me. I dont have a beef with him. What I do have a beef with is their actions. They were yelled at on sunday also. For attempting to cause a stir. If this was an isolated incident, people may be more receptive to these excuses. But it is not. I have been to 4 local tourneys. 3 UXPL's and the MWXPL. At all of them Kevin has done something to embarass the paintball community. Whether it be cussing and yelling at the refs, throwing guns, or acting childish. It has happened.

I just think he needs to take a step back and re-evaluate his course of actions. I hope he does find a solution. We can ill afford to lose any shops or fields.

tommy said no such thing. he said earlier were gonna lite kevin. up in a joking way, because kevins staging area was right next to are. and he sad that to kevin and just laughed. he nowwhere said keep shooting kevin till he gets out. of course the team shot at him. you would too if he started shooting back at you from the deadbox, tommy had nothing to do with that overshooting. so impy get your facts straight or maybe let nich do the talking alright.

How can one that cheats complain when he get lit up? It would be expected. If you are known for wiping and brag about it after beating a team it would be expected the next time to play them that they would keep shooting till you call your self out. Getting shot while going to the dead box, don't walk in lanes, I wasn't there to see it as I was playing woodsball with my tippmann( a few of those will get the joke in that, although Tippmanns are still great guns)

YAYA!

This is beside the fact. You are a business owner. You need to set examples. You need to be a guide and a protector of the sport. Without it, you are out of business. Spinning, wiping, playing on. They all happen. But your skin needs to be thicker. You often speak of other teams cheating. And get mad when it happens to your team. But condone it for your team.

Be a man, be a father and be a coach. And take the high road. Their are enough people dragging the sport down. We definatly dont need a shop owner leading the charge![/QUOTE]

You are correct I made some bad mistacks and I apologize for it. There is some other unrelated items that I let influance my play. I am going to step back and let things run their course. I have a lot of respect for everyone and it was fun playing with you. Thanks for letting me speek my .25 worth. This is my last response.

I have several things to address here so bare with me.

First, and this is just a minor thing--but you will see how it matters as you read on--Slander applies in no way to this forum as everything said here is written, thus Libel laws and not slander laws apply. Ergo, even if you were to try and press the issue nothing that has been said would pass the libel test established by the supreme court in New York Times v. Sullivan as there is no "malicious intent" or any attempt to "defame the charactor" of anyone who is mentioned. That said I am surprised that Kevin doesn't have a better understanding of that law as he sure seemed to know all about the law when he told Craig that he had "no legal ground to stand on" when Craig told him he couldn't stage in the parking lot.

I'd like to interject here that I think Kevin should put on and run an event.

I'll continue. In order to maintain order and organization certain areas are set up for players to stage at events. This allows the promoter to provide a better setting for players and for spectators alike. Kevin was thowing a fit about not being able to stage in the parking lot. I was impressed at how Craig kept his cool and went out of his way to put up with Kevin's threats and attitude.

Kevin and his daughter were rostered by a group of players very new to tournament paintball. Thier first tournament was the USG, the SLC open was thier second tournament. I know the players of Messiah paintball personally and saw how much they sacrificed to prepare and even make it to the tournament. They scraped together every penny they had and then drove 4 hours to participate. They wanted to play hard and win just like anyone else. For this reason I paid close attention to their games when I had the chance. All of you who saw the game know that after Kevin got hit he didn't immediatly pull himself from the game. As he was walking off he was hit only a handful of times, then he turned and fired, a 1 for 1 was pulled, he turned and fired again another penalty was pulled then he shot from the deadbox. What a joke. I agree wholeheartedly with the above commments about the conduct of not only a store owner but an event sponsor. What he did was bad for any player, worse for a store owner and even worse because it flys in the face of the sacrifice the other members of Messiah made.

As far as Nich is concerned, what he did was malicious and nothing less. Further, Nich talked to Craig and told him that he couldn't call the team Headache because Ballistic had paid for the entry when in fact the players themselves had given Kevin the money to pay for the event. Correct me if I'm wrong on the next point but Kevin was also paid for the paint he bought for them in the finals. I personaly don't blame them for 1- not wanting to be associated with the Ballistic store or 2- for being extremely hurt on a personal level for the conduct displayed.

There is no excuse for that type of malicious behavior. In addition, while I don't know for sure, I doubt Kevin encouraged Nich to maliciously assault Tommy. I am sure Nich is asking himself right now what buisness he had even being on the team if they were able to take the event without him. Finally, to the person who made the comment that Nich did the team a favor, you are a moron. Saying that malicious conduct such as that displayed by Nich has any type of place is malarky. What Nich did and his continued attitude and behavior throughout the rest of the tournament was disgusting.

I applaud Craig and Rick for not backing down or showing preferential treatment to their sponsors. I was apalled when Dale Price questioned whether or not Rick was sure he wanted to DQ his team and said something to the effect that it would be bad for him to do so when the Turtles were caught using non-event paint. Further, I was shocked when Dale immediatly left the field and took the chronographs he had let the MWXPL use. I think that behavior was infantile, especially from a shop and field owner. What message where they trying to send?

Kevin and Dale, don't you realize the close scrutiny you are put under? People looked up to and admired you and you respond with childlike behavior, loss of temper and a sharp tougue? This type of behavior just doesn't have a place in the sport. I heard many people say that store owners are people too, no kidding, their behavior however has strong bearing on just how long they stay store owners.

To conclude, the MWXPL did a fine job of running a tournament with all the drama. The event was far from perfect (just ask team Fixx), but no other venue has offered players the level of competition, the prizes and the "fruit and water" that the MWXPL has. This was confirmed by the strong words of praise given by all the teams at the end of the event and especially by those who came from Nevada and Colorado. Until you run an event you just can't even imagine what it takes to put one on. The addage "if you aren't part of the solution then you are part of the problem" really applies to paintball events. If you don't like what is going on whining about it and bad mouthing the event will change nothing. Get in and work and do your part to make it better. At the end of the Day the UXPL, USG, MWXPL and Addicts tournament promoters are to be applauded for all they do and have done for paintball. And, despite his behavior this weekend no-one has done more for paintball in Utah than Dale Price.

One more thing and this is for Switzerland (you know who you are), your behavior, attitude and buisness ethic is supurb. It won't be long before you will be the number one purveyor of paintball in your area.

You were appalled that he left the field.. Well if you are DQ'd for using non field paint and have no more games, what else are you supposed to do. Would you rather have a large argument and big scene occur or have them pick up all their gear ( including equipment) and heading home. They played their first 8 games honest and fair with field paint, then went on the last game basically knowing that they would be dq'd. (as far as I know)

Just wondering cus I don't know who you are... But who is Audiomaster?

Ya Howdy

Slander etc.

I would not be so quick to state that there is no case for slander or libel. Although I am certain that the grounds for such a case would be both thin and easily contestable. However, libel and slander DO NOT require malicious intent. Only a charge of CRIMINAL libel or slander requires malicious intent; but both libel and slander can be brought forth in civil court, under the following definitions: (these are direct and unabridged from the latest edition of "Black's Law Dictionary")

LIBEL= "A defamatory statement expressed in a fixed medium, esp. writing but also a picture, sign, or electronic broadcast."

CRIMINAL LIBEL= "At common law, a malicious libel that is designed to expose a person to hatred, contempt, or ridicule and that may thus subject the author to criminal sanctions."

SLANDER= "A defamatory statement expressed in a transitonary form, esp. speech."

CRIMINAL SLANDER= "A false defamatory statement of malicious origin made orally, which casts doubt or contempt on another person's character, rights, or property."

"I'd like to interject here that I think Kevin should put on and run an event."

This will be my one and only post due to my parents told me not to reply to anyone on here for certain reasons...

well my dad (kevin) has ran an event he helped run the ballistic addicts tournament and it was better then ever!!!
and he didnt make that big of a deal that he couldnt stage out of our trailer he did make a little one because it has airconditioning and alot of teams always stop by to get out of the heat... and due to not being able to get out of the heat ALOT of players including me, got sick.
